1. Irrecoverable
1.1 Key Issue for Decision
1.1.1 To consider the approval to write off an amount of £310,995.64 in respect of nineteen non domestic rate debts.
1.2 Recommendation of the Head of Finance and Customer Services
1.2.1 That the following amounts, together with those shown on the attached Exempt Appendix are written off:

1.2.2 Leisureworld UK Ltd – 3199368 – The company traded from 74 Week Street, Maidstone and the debt is in respect of the period 1 April 2009 to 6 December 2009. Appropriate recovery action was taken, but the company ceased trading and the company was placed into Administration. The Administrator has advised that there will be no funds available for unsecured creditors.
1.2.3 Leisureworld UK Ltd – 3201470 – The company traded from 90 Week Street, Maidstone and the debt is in respect of the period 1 April 2009 to 6 December 2009. Appropriate recovery action was taken, but the company ceased trading and the company was placed into Administration. The Administrator has advised that there will be no funds available for unsecured creditors.
1.2.4 Pete’s Garage Services Ltd – 3182569 – The company traded from Units 1-3 The Warehouse, Granville Rd Maidstone and the debt is in respect of the period 1 July 2007 to 31 August 2010. Appropriate recovery action was taken, but the company ceased trading and was struck off the company register. There are neither funds nor goods upon which we could levy distress and there will not be any funds available for creditors.
1.2.5 Kemsing Catering Company Ltd – 3182184 – The company traded from 67B Week Street, Maidstone and the debt is in respect of the period 4 May 2007 to 19 April 2010. Appropriate recovery action was taken, but the company ceased trading and was subsequently dissolved. There are neither funds nor goods upon which we could levy distress and there will not be any funds available for creditors.
1.2.6 Sofia Prosperity Ltd – 3201158 – The company traded from Unit F St Michaels Close, Maidstone and the debt is in respect of the period 11 April 2009 to 22 September 2009. Appropriate recovery action was taken, but the company ceased trading and was subsequently dissolved. There are neither funds nor goods upon which we could levy distress and there will not be any funds available for creditors.
1.2.7 Westport Design Ltd – 3194665 – The company traded from 1-2 Foster Street, Maidstone and the debt is in respect of the period 10 November 2006 to 10 July 2008. Appropriate recovery action was taken, but the company ceased trading and the company was placed into Liquidation on 23 August 2010. The Liquidator has advised that there will be no funds available for unsecured creditors.
1.2.8 Diamonds and Pearls Ltd – 3195339 – The company traded from 310 Dukes Walk, Maidstone and the debt is in respect of the period 27 October 2008 to 1 March 2009. Appropriate recovery action was taken, but the company ceased trading and the company was placed into Administration then Liquidation. The Liquidator has advised that there will be no funds available for unsecured creditors.
1.2.9 James Theobald Ltd – 3147567 – The company traded from Unit 1 Bircholt Rd, Maidstone and the debt is in respect of the period 1 April 2010 to 30 April 2010. Appropriate recovery action was taken, but the company ceased trading and the company was placed into Administration. The Administrator has advised that there will be no funds available for unsecured creditors.
1.2.10 The Bed Emporium Ltd – 3190618 – The company traded from 235-236 Water lane, Maidstone and the debt is in respect of the period 2 May 2008 to 30 June 2010. Appropriate recovery action was taken, but the company ceased trading and was subsequently dissolved. There are neither funds nor goods upon which we could levy distress and there will not be any funds available for creditors.
1.2.11 Earnshaw & D’Avola Ltd – 3192190 – The company traded from The Harrow, Warren St, Lenham, Maidstone and the debt is in respect of the period 15 June 2008 to 12 October 2009. Appropriate recovery action was taken, but the company ceased trading. There is no indication of any funds being available for the benefit of creditors.
1.2.12 Stawberry Moons (A Place in Time) Ltd – 3060317 – The company traded from Café Romba, 33 Gabriels Hill, Maidstone and the debt is in respect of the period 24 September 1992 to 11 February 2010. Appropriate recovery action was taken, but the company ceased trading and the company was placed into Liquidation on 15 March 2010. The Liquidator has advised that there will be no funds available for unsecured creditors.
1.2.13 Stawberry Moons (A Place in Time) Ltd – 3142962 – The company traded from 28-32 Gabriels Hill, Maidstone and the debt is in respect of the period 1 April 2009 to 11 February 2010. Appropriate recovery action was taken, but the company ceased trading and the company was placed into Liquidation. The Liquidator has advised that there will be no funds available for unsecured creditors.
1.2.14 MPL Utilities Ltd – 3172347 – The company traded from Hillside Works, Old Mill Lane, Maidstone and the debt is in respect of the period 1 April 2008 to 31 December 2009. Appropriate recovery action was taken, but the company ceased trading and was subsequently dissolved. There are neither funds nor goods upon which we could levy distress and there will not be any funds available for creditors.
1.2.15 Larrell Services Ltd – 3186524 – The company traded as V Bar from 14 Middle Row, Maidstone and the debt is in respect of the period 6 November 2007 to 12 May 2009. Appropriate recovery action was taken, but the company ceased trading and was subsequently dissolved. There are neither funds nor goods upon which we could levy distress and there will not be any funds available for creditors.
1.2.16 Kent Mechanical Services Ltd – 3154595 – The company traded from Detling Aerodrome, Maidstone and the debt is in respect of the period 1 April 2009 to 31 August 2010. Appropriate recovery action was taken, but the company ceased trading and went into Liquidation on 1 June 2010. The Liquidator has advised that there will be no funds available for unsecured creditors and we are waiting for details of the surrender of the lease.
1.3 Reasons for Recommendation
1.3.1 The reasons for each of the cases are either listed above or contained in the exempt appendix. In summary, the companies or individuals concerned have gone through an insolvency process and funds are not available for any creditors.
1.4 Alternative Action and why not Recommended
1.4.1 The debts could be left on the system, but this would serve no useful purpose and maintain the arrears at an artificially high level.
