Statement of reasons

The Borough of Maidstone (off street parking places) 2018.
(variation no. 2) order 2022

The Maidstone Borough Council intends to make the above-named order, in order to:

  1. Increase the Season Ticket charges applicable to car parks as approved by the Strategic Planning and Infrastructure Committee on 7 December 2021.

The Council of the Borough of Maidstone (“the Council”) in exercise of its powers under section 35(1) and (3) of the Road Traffic Regulation Act 1984 (“the Act”) and Part IV of Schedule 9 to the Act, and of all other enabling powers, with the consent of the Kent County Council in accordance with section 39(3) of the Act and after consulting the chief officer of police in accordance with Part III of Schedule 9 to the Act, hereby propose to make the following order:-

  1. This Order may be cited as “The Borough of Maidstone (Off-street Parking Places) (Variation No.2) Order 2022” and shall come into Effect on the xxxxxxxxx.
  2. In this Order the expression “Order of 2018” means The Maidstone Borough Council (Off-Street Parking Places) Order 2018.
  3. The Order of 2018 shall have effect as though

    (i) in Schedule 1 thereto, the details specified in Part (I), charges relating to Parking Places, items 1,4,6,9,11,16, and 18 shall be amended

    (ii) in Part (II) Schedule 2 (Season Tickets) thereto, items 1and 2 shall be amended.

    (iii) Amend article 4.5 to the following text;

No person shall cause a vehicle to be parked in a parking space where there is a sign or surface which indicates that a parking bay is available only for electric vehicles, only electric vehicles may use that parking place and must at all times be connected via a rechargeable lead to the charging point installed in respect of that parking place and is being charged during the whole period it is parked within the parking space. A maximum stay of 4 hours with no return shall apply to all bays thus marked.

(iv) Amend article 8.2 (g) to the following text;

in a position reserved for an electric vehicle, or not being connected via a rechargeable lead and not being charged for the whole period for which it is parked in respect of that parking place;

Notice is hereby given that Maidstone Borough Council intend to make the above order under section 35 of the Road Traffic Regulation Act 1984, having obtained the consent of the Kent County Council in accordance with Section 39(3) of the Act, and of all other enabling powers, and after consultation with the chief officer of police in accordance with Part III of Schedule 9 of the Act -

The Order will;

Revise the current Season Ticket charges contained in the schedules to the above order as shown in the tables below, and Introduce an Electric vehicle parking/charging of £0.25 per kilowatt hour (kWh) within our Car Parks

The Order includes some wording changes of an administrative matter that will make no alterations to existing parking and waiting restrictions and will require no changes to existing parking lines or signs.

Copies of the proposed Orders, any Orders which will be amended by the proposed Orders, a statement of the Council's reasons for proposing to make the Orders and indicating the location and effect may be examined online from Friday 21 January 2022.
