Purpose:

To consider the possibility of negotiating an extension to the term of the existing management contract in respect of the Cobtree Manor Park Golf Course.

 

Decision:

That no further action be taken with regard to the negotiation of an extension to the term of the existing management contract in respect of the Cobtree Manor Park Golf Course.

 

Reasons for the decision:

At the last meeting of the Committee consideration was given to a request from the golf course management contractor for a contribution towards the provision of an all-weather path to increase the amount of usage during the winter months.  The Committee felt unable to make the contribution in light of the planned expenditure to enhance the Cobtree Manor Park and it was resolved that Officers should explore the possibility of negotiating an extension to the term of the existing management contract in return for the contractor making additional capital investment in the facilities, including the provision of the all-weather path.

The contract was let in January 2009 for an initial period of 5 years, with a further period of five years provided that the contractor performs satisfactorily throughout the initial period.

The Procurement Section has advised that there is no legal basis on which the Council can negotiate an extension to the existing contract which was awarded under a competitive tendering arrangement.

Under the circumstances it is considered that no further action should be taken on this matter.

The Officers will encourage the contractor to take a positive view of the situation.  The partnership basis on which the contract is drawn should ensure that the performance of the contractor remains at a satisfactory standard throughout the initial period and thus ensure that the further period of five years comes into effect.

Alternative options considered:

The alternative course of action is to ignore the advice provided by the Procurement Section and to seek to negotiate an extension.  This action is not considered appropriate as individual Members may be liable for any costs resulting from a challenge to the decision.
