Draft AQMA Order for Proposed AQMA
MAISTONE BOROUGH COUNCIL
THE UPPER STONE STREET AIR QUALITY MANAGEMENT AREA (AQMA) ORDER 2022
ENVIRONMENT ACT 1995 PART IV – SECTION 83(1)
Whereas Maidstone Borough Council (“The Council”) is satisfied that as a result of its air quality review and the Detailed Assessment report dated December 2021 the air quality objective for Nitrogen Dioxide (NO2) (annual mean) may not be achieved by the relevant date prescribed by the Air Quality (England) (Wales) Regulations 2000 in some parts of the area described below.
The Council, in exercise of the powers conferred on it by section 83(1) of the Environment Act 1995 HEREBY ORDER THAT:-
- The area of Upper Stone Street, between Wrens Cross and Old Tovil Road as shaded in red on the attached map shall be designated as an Air Quality Management Area, to be known as the Upper Stone Street Air Quality Management Area.
- The Air Quality Management Area will be an air quality management area in relation to Nitrogen Dioxide (NO2) only.
- The order shall be cited as The Upper Stone Street Air Quality Management Area Order (2022).
- The order shall come into force on 1st December 2022 and shall remain in force until varied or revoked by subsequent order.
